These conditions are intended to define, on the one hand, the conditions of use of the Internet site at www.pietrobrunelli.it ("THE Site"), an e-commerce site, applicable to any visit to the site and, on the other, the contractual scope of the distance selling of goods (hereinafter also referred to as "products") to the consumer who purchases products from our company and/or requests to take advantage of an offer or benefit proposed on the Site by BRUNELLI & CO SRL.

Acceptance of the terms of use
Visiting the Site implies that the Internet user has accepted these conditions of use.

Respect for intellectual property rights
The brands and other intellectual property rights inherent to the content of the Site and to any distinctive PIETRO BRUNELLI sign are the property of BRUNELLI & CO SRL and/or, in the case of partner brands, of the relevant entities.
Specifically, the nominative and semi-figurative trademarks PIETRO BRUNELLI are trademarks registered by BRUNELLI & CO SRL and are protected by trademark law.
The intellectual property rights on the trademarks, logos, the name of a product or collection, the graphics, drawings, models, product creation and all elements of the Site, whether visual or audio, including the underlying technology, the branching and the compilation thereof, as well as each of the elements created appearing on the Site or created for the Site are the exclusive property of BRUNELLI & CO SRL or, where applicable, its suppliers and the latter and they do not grant any license or any other right other than that of consulting the Site.
Reproduction of any document published on the Site is authorized only for information purposes for personal and private use. Any reproduction, in whole or in part, of copies made for other purposes is expressly prohibited without the prior written authorization of BRUNELLI & CO SRL.
Consequently, any reproduction and/or representation without the prior written consent of BRUNELLI & CO SRL or the interested party will constitute an infringement and will be prosecuted and sanctioned in accordance with trademark law and copyright protection.

Respect for the rights of others
When using the Internet, any visitor to the website or the official PIETRO BRUNELLI pages on social networks must behave in a manner that respects the rights of third parties and of BRUNELLI & CO SRL.

Free text area
Specifically, Internet users are prohibited from writing any message that is abusive, racist, discriminatory, or offends public morality, or that conveys violence in any way, or that harms a person's reputation or image, in the free text areas of the Site and/or on the official PIETRO BRUNELLI pages of social networks, including specifically Facebook, YouTube, Instagram, Pinterest, and Twitter, under penalty of liability.

Creating a hypertext link
Any creation of a simple hypertext link to the home page of the Site or to any other page of the Site is subject to the prior written consent of BRUNELLI & CO SRL, under penalty of liability of the Internet user who creates a link to the Site.
However, any hypertext link to the Site using the technique known as "framing" or "inline linking" is formally prohibited.
In any case, any link, even if tacitly authorized, must be removed upon simple request by BRUNELLI & CO SRL.
BRUNELLI & CO SRL disclaims all liability in the event that the content of sites other than the Site, to which hypertext links may refer, violates laws and current regulations.

Internet Safety and Responsibility
As an Internet user, the visitor to the Site and/or the Buyer declares to be aware of the risks and contingencies of the Internet and, in particular, its functional characteristics and technical performance, the risks of interruption, response times for consulting, querying or transferring information, and the risks, in particular, of data transfer, despite the security measures that BRUNELLI & CO SRL takes.
The www.pietrobrunelli.it website is a secure site. A secure site can be recognized by the "https" symbol preceding the website address, confirming that it is an official site. The "s" added to the usual "http" stands for "secure" (Hyper Text Transfer Protocol Secure). The symbol of a key or closed padlock also appears in the address bar of the e-commerce site. BRUNELLI & CO SRL recommends that visitors and/or customers of the site carefully check that the address of the site they are connecting to actually contains these symbols, to ensure they are on the official website www.pietrobrunelli.it.
It is the responsibility of any Internet user to take measures to protect the data and/or software stored on their computer devices from any attack, by carrying out all necessary or useful printouts, recordings and virus detection analyses.
In particular, due to the Internet communication technique, BRUNELLI & CO SRL must decline all responsibility in the event of:
Any damage resulting from a fraudulent intrusion by a third party which cannot be attributed to BRUNELLI & CO SRL, which may have led to a modification of the information made available on the Site;
more generally, for all damages, direct or indirect, material or immaterial, such as operating losses, loss of profits, loss of enjoyment, for any cause, origin, nature or consequence, caused by access by an unauthorised person to the Site or the impossibility of accessing it following interruption, suspension or malfunction, and more generally by the connection and/or use of the Site.
BRUNELLI & CO SRL declines all responsibility for the consequences of a malicious act caused by a third party and having been able to proceed with a modification of the content of the Site, when BRUNELLI & CO SRL has made every effort to take adequate protections with respect to technology and the evolution of techniques.

Information on the protection of personal data
In accordance with European regulations (GDPR) and Italian law, you have the rights of access, rectification, deletion, portability, and objection to the processing or transmission of your data to partners. You may thus receive commercial offers from other advertisers. For this reason, unless you object, which can be exercised in the collection form and subsequently at any time, your postal contact details may be shared with BRUNELLI & CO SRL's commercial partners.
The email address provided by the user may be shared with our partners only with their consent. In any case, the user has the right to withdraw their consent or object to such communication or processing at any time.
Other personal information may be collected and processed.
BRUNELLI & CO SRL may need to process personal data concerning the user, necessary for the execution of the sales contract or for the processing of his/her data and rights or to comply with a legal obligation, as well as data useful for the legitimate interest of better serving the user, ensuring the commercial success of commercial offers and diversifying them, allowing the user to benefit from benefits and targeted and personalized advertising.
Some user data may be collected and processed only with your express consent.
Site visitors and buyers are invited to read our privacy policy and data protection cookies policy.

WEB Tag
Some of the Site's web pages may contain electronic images or "web tags," which, for example, allow us to count the number of visitors to the page. These web tags may be used with some of our partners, particularly to measure and improve the effectiveness of certain advertisements. In any case, the information obtained through these tags is strictly anonymous and simply allows us to compile statistics on the use of certain pages of the Site, in order to better serve our Site's customers.

Absence of effect of any tolerance
Failure to avail yourself of any of the provisions of the General Conditions of Sale and Use at any given time cannot be interpreted as a waiver by BRUNELLI & CO SRL to further avail yourself of any of said conditions.

GENERAL CONDITIONS OF SALE
The General Terms and Conditions of Sale and Use are drafted in Italian. In the event of any discrepancies between the Italian text and any translation into another language, the Italian text shall prevail over any translation into another language.

Sales on the Site for the consumer
The general conditions of sale are concluded between the company BRUNELLI & CO SRL with capital of 30,000 euros, a company under Italian law registered in the Milan Companies Register under number MI1704316, identified with VAT number 03817060969 and whose registered office is at Galleria San Babila 4B, 20122 Milan, hereinafter referred to as "BRUNELLI & CO SRL" or "PIETRO BRUNELLI" and, on the other hand, any natural person not acting as a trader, but as a consumer, wishing to make a purchase through the Site, for non-professional use, hereinafter referred to as "the Buyer", to govern the contractual relationship.
Orders from professionals or persons considered to be such are therefore excluded and cannot be served, especially if the order exceeds the normal needs of a consumer or is part of an anomalous flow of orders to the same billing or delivery address.
Some offers may be conveyed through platforms affiliated with our company or through commercial partners, who do not sell the products but refer to the Site where the Buyer can take advantage of the offers with complete peace of mind without an intermediary.
It is prohibited to purchase the items offered on the Site or ask to take advantage of gifts or benefits offered in addition to our offers, in order to resell them as new, specifically on websites and/or in shops external to BRUNELLI & CO SRL and/or in markets.
Any violation of this prohibition constitutes an attack on the rights of BRUNELLI & CO SRL, specifically an attack on its trademarks, including PIETRO BRUNELLI, and on the company's brand image, as well as its copyright on the goods, collection names, and creations, and is such as to engage the responsibility of its author.
These general conditions of sale are available to any consumer and can be read or printed before confirming any order with BRUNELLI & CO SRL and at any time.
Any consumer order is governed by the conditions in force on the date of order confirmation.

Acceptance of the conditions
The Buyer acknowledges having read these general conditions of sale before confirming the order.
Confirming an order on the Site implies the full acceptance of the consumer who declares to accept them entirely and without reservations to govern the contractual relations between BRUNELLI & CO SRL and its Buyer customer.
By mutual agreement between both parties, they will prevail over any other condition contained in any other document, unless otherwise expressly and in writing.

Capacity to contract and orders of minors
Unemancipated minors may not ordain without the prior consent of a parent or legal representative.
Personal data concerning minors: In accordance with European legislation, BRUNELLI & CO SRL cannot process or store the personal information of minors under 16 years of age. Processing is only lawful if consent is given jointly by the minor concerned and the holder(s) of parental authority over the minor.
Consequently, BRUNELLI & CO SRL does not accept orders confirmed by a minor under 16 years of age.
If, despite all care and precautions taken, BRUNELLI & CO SRL records data of minors, by mistake or due to deception of the minor by not correctly informing him/her of his/her age, the minor's data will be deleted upon receipt of the order and/or information.

Order
Each order implies acceptance of the prices and descriptions of the products offered for sale.
Automatic registration systems are considered as having proof of the nature, content and date of the order.
BRUNELLI & CO SRL confirms acceptance of the order to the Buyer at the email address provided by the Buyer. The sale will be concluded only upon confirmation of the order and validation of the payment by the relevant banking institution.
The information provided by the Buyer during the order is binding: in the event of an error in indicating the recipient's contact details, BRUNELLI & CO SRL cannot be held responsible for any inability to deliver the product.
BRUNELLI & CO SRL reserves the right to cancel any order from a Buyer with whom there is a dispute regarding the payment of a previous order.

PRODUCTS

Product Availability
Product availability indicated on the website refers to actual availability at the time the Buyer places the order. However, this availability should be considered indicative due to the potential presence of multiple users on the website making a purchase at the same time, meaning that in-stock products may also be sold to other Buyers between the time of order placement and order confirmation.
When one or more products in an order are unavailable for reasons beyond BRUNELLI & CO SRL's control, the order will be modified by removing the unavailable product(s). The customer will be notified by email and will be refunded.

Promotions
Promotional offers may be offered for the duration indicated in the offer and subject to available stock.
For offers in a category or product series, only the products and colors in that category are eligible for the promotion.
The Buyer is not authorized under any circumstances, on his own initiative, to modify, alter or introduce a product price other than that proposed by BRUNELLI & CO SRL for a purchase on the Site.

Price
Every order placed by a consumer with BRUNELLI & CO SRL implies acceptance of the selling prices of the items displayed on the Site at the time the Buyer confirms the order. The prices applicable to the ordered products are those in effect on the date the order is confirmed on the Site.
The selling price is the price of the current General Price List (the "General Price List") or, if the product chosen on the Site is on promotion, the promotional price for the duration of the offer itself.
The price is expressed in euros and is indicated on the product sheet, inclusive of taxes, including VAT based on the applicable rate for sales within the European Union. For deliveries outside the European Union, prices are indicated upon order validation, excluding taxes. The price may be modified upon order validation to take into account the destination country's tax rate, payable by the Buyer.
The price listed on the product pages does not include shipping. Shipping costs are specified on the cart screen and are added to the total amount to be paid before confirming the order, after selecting one of the available delivery methods.
The price indicated in the order confirmation is the final price, inclusive of taxes. The final price includes the price of the products, handling, packaging, and storage costs, and shipping costs.
Any changes in the applicable VAT rate may be reflected in the product prices.
Likewise, if one or more taxes or contributions, specifically environmental ones, are created or modified, upwards or downwards, such change may impact the selling price of the items listed on the site and in the sales documents.
However, prices cannot be changed after the Buyer's order has been validated.
The prices of the items ordered on the site are valid according to the references of the catalogue from which they originate and the date indicated in the relevant catalogue.

Price reduction announcements
The benefits and price reductions are calculated on the basis of the General Annual Price List which constitutes the reference price.

Description of order forwarding on the Site
By placing an order, we mean the set of actions the user performs, from choosing the products to the final validation of the order, so that it is registered.
It is made up of various stages:
Cart/Address (account data)/Delivery method/Payment
Registration confirms the order.
- First Phase: choosing products ("Cart")
The user selects the desired items to order; they can view their cart at any time by clicking "Cart" at the top of the page and access the terms and conditions of processing and delivery charges.
When making a selection, the user is directed to the product description in the product sheet.
- Second Phase: order validation
During the cart validation stage, the order total indicates the amount that will be paid if no other products are added.
At any time before final confirmation of the order, you can change or add other products or terminate the order itself.
In accordance with the law, users are reminded that confirming their order obligates them to pay for their purchases. By confirming their order, users agree to pay using the payment methods chosen in the subsequent steps to complete the order process.
- Third Phase: Identification and account opening
At this stage the user creates a personal account or identifies himself if he has one.
Creating an account is recommended because it saves you from having to enter the personal data required to process your order each time you visit the Site.
It is important to include your telephone number, address, and email address so that customer service can contact you if necessary.
- Fourth Phase: choosing the delivery and payment method
The user selects the delivery method from those offered depending on the delivery location and payment method.
The amount of participation in the processing and shipping or delivery costs of the order is added to the order total or is offered depending on the order total (in which case the costs are displayed with the amount equal to zero).
The user is asked to validate the order: «CONFIRM THE ORDER».
- Fifth Phase: Payment of the order
The user is asked to proceed with payment for the order ("PAY Secure Payment"), depending on the choice made.
If you choose to pay by credit card, after confirming your order, you will be redirected to the secure payment page of the e-commerce service provider chosen by BRUNELLI & CO SRL for secure online payments.
The order will then be registered.

Order confirmation
The accepted order involves the confirmation of the order by sending an email after the order has been registered.
As soon as your order is registered on the Site, a detailed receipt serving as order confirmation will be automatically sent to your email address. This order confirmation will specify the invoice amount and the order's delivery method.
Return receipts automatically sent to the customer are considered acceptance of the order only after further verification by BRUNELLI & CO SRL customer service that the order complies with the offer.
BRUNELLI & CO SRL reserves the right to cancel any non-compliant order.
The order confirmation is accompanied by a communication of the general conditions in force on the date of the order.

The account
The user can create his customer space without having to place an order.
From the account, the user can manage orders and billing.
To create an account, the buyer must accept the cookies necessary for recognizing the account and identifiers, which are personal data.
When creating an account and signing up, you will be asked to enter an email address and choose a password that will authorize access to your account. Your account will be protected by your chosen password. For greater security, we encourage you to use complex passwords (including a mix of uppercase and lowercase letters and numbers).
Only one account will be assigned per email address.
However, you must not disclose it to anyone else; we cannot be held responsible for fraudulent use of your password or email address by a third party.

Change password :
If you lose or forget your password, you can click "Forgot your password?" to receive a password reset email to the email address you provided when you created your account.

Change your delivery or billing information
After logging in, you can log in to your account and click "Edit Addresses." You can then change your delivery or billing information:
Confidentiality of personal data
Providing the personal information collected to conclude or execute the distance selling contract is mandatory. This information is essential for processing and forwarding orders, preparing invoices, exercising warranties, managing and collecting outstanding payments, and exercising your rights.
Failure to enter will result in the order not being validated.

DELIVERY METHODS AND PARTICIPATION IN HANDLING AND DELIVERY COSTS

DELIVERY METHODS
Shipping and delivery times may be subject to delays in the event of exceptional circumstances. Shipments to Sardinia, Sicily, islands, and remote areas or those with special tax regimes may require longer delivery times.

CUSTOMS DUTIES
Any order confirmed on the site and delivered outside the European Union may be subject to any taxes and customs duties which are imposed when the package reaches its destination.
These customs duties and any taxes associated with the delivery of an item are the responsibility of the customer. To learn more about them, it is the customer's responsibility to contact the relevant authorities in their country.

MAXIMUM DELIVERY TIME AND DELAY TIME
Shipping and delivery times may be delayed in the event of exceptional events.
After the stated shipping deadlines, the user may cancel the order by letter or any other written communication on another durable medium, if BRUNELLI & CO SRL has not yet done so. The contract will be considered terminated upon receipt of the letter or written communication informing of such termination, unless the user has received the delivery in the meantime and agrees to retain the items received.
However, in accordance with the Law, the user has the right, as a consumer, to immediately terminate the contract if the delivery date or term constitutes an essential condition of the contract for the user, resulting from the circumstances of the conclusion of the contract or from an express request by the user prior to the conclusion of the contract. In the event of termination, all sums paid will be refunded to the user within fourteen days of the date on which the contract was terminated.

DELIVERY METHODS
The delivery service provider will deliver the order to the address that the Buyer has provided to BRUNELLI & CO SRL.
If the Customer fails to collect the package within the deadline set by the chosen shipping provider, it will be returned to BRUNELLI & CO SRL. In this case, unless the Buyer has contacted BRUNELLI & CO SRL to request a new shipment at their expense, the order will be cancelled and refunded (excluding shipping costs). In the event of an unusual delivery time or loss of the ordered products, the Customer is invited to inform BRUNELLI & CO SRL, which will open an investigation with its service providers.
BRUNELLI & CO SRL recommends that buyers always check their packages upon arrival.
Please note that BRUNELLI & CO SRL has three days (excluding holidays) to raise any concerns by registered letter with the carrier in the event of missing or damaged items. This implies that the Buyer must inform Brunelli & Co immediately of any anomaly or missing item discovered upon receipt of the package.
In the event that the ordered products are stored in different warehouses, BRUNELLI & CO SRL reserves the right to divide the order into multiple shipments.
When BRUNELLI & CO SRL partially ships an order, the missing item(s) will be refunded, unless the Buyer agrees to an extension of the deadline.

RIGHT OF WITHDRAWAL
The customer has a legal right of withdrawal of 14 days from the date of receipt of the order.
Under this right of withdrawal, the customer can decide to return unwanted products by completing the form in the Return Conditions . After informing us of the exercise of this right or printing the return label, the user has 14 days to leave the package with the selected carrier or arrange for collection at the shipping address provided at the time of purchase.
This right of return, however, is only valid to the extent that the customer has tried the Product on in a reasonable manner (for example to check the size, appearance, style, comfort, etc.) and the item has been returned to us complete, intact, with the original packaging and in perfect condition.
When exercising the right of withdrawal, the Buyer will be refunded the total cost of the returned products, excluding shipping costs. Return shipping costs are the customer's responsibility and amount to €7.90 for domestic returns and €16.90 for international returns; this amount will be deducted from the refund total. Refunds will be made using the same payment method used by the Buyer for the initial transaction, where possible. The customer can receive a voucher of the same value (valid for 12 months) if they have accepted the offer, or a bank transfer.
If you paid by credit card, the amount will be credited directly to your card; if you used a gift card or non-refundable voucher, you will receive a gift card or voucher for the same amount and duration as the one used.
In this case, the buyer is required to use the return label provided by BRUNELLI & CO SRL. Any shipments made by the buyer without contacting BRUNELLI & CO SRL will not be refunded.
The item(s) for which the right of withdrawal is exercised must be returned unused in their original packaging or, if removed, with such packaging intact, with all accessories, instructions for use, and documentation.
The customer must log in to the returns portal found in the Return Policy and complete the appropriate form, specifying the reason for the exchange and the quantity to be returned. The customer will receive the return label and instructions via email within 2-3 business days.

In accordance with the law, a devaluation may be applied to the price to be refunded in the event of non-compliant or unreasonable use.
BRUNELLI & CO SRL will inspect returned products. Refunds will be issued upon receipt of proof of return and/or receipt of the product.
BRUNELLI & CO SRL reserves the right to refuse any package returned after the deadline and to return it to the customer at the customer's expense.

The customer loses any benefits and discounts (e.g. free shipping for orders over €120) that may have been granted to him/her if such benefits and discounts are not applicable to the value of the order net of the return.

For health and hygiene reasons, returns of panties or bodysuits that have been tried on, and of socks and tights if the packaging has been opened, will not be accepted. The customer does not have the right of withdrawal for underwear and swimwear that have been used.

PAYMENT
Customers can choose from various payment methods. They can pay for their order by credit card, cash on delivery, PayPal, or bank transfer.

Secure payment by credit card
Payment by credit card is made through our secure payment service provider. The transaction amount will be charged within 48 hours of payment being made. The following online payment methods are accepted:
Visa / Mastercard / American Express / Maestro
Transaction data is encrypted with a bank validation server. BRUNELLI & CO SRL only uses encryption protocols deemed secure. Buyer data is never transmitted in clear text. The Buyer enters the credit card number, cryptogram, and expiration date of the card used on a secure page of our payment service provider. The payment request is transmitted and forwarded in real time. The secure payment service provider performs various checks to prevent abuse and fraud.
Bank details are used only to complete the transaction. BRUNELLI & CO SRL does not have access to the Buyer's card details; only the bank does via the secure platform.
The order validated by the Buyer will be considered effective only after the relevant bank payment center has given its approval. In the event of refusal to accept, the order will be automatically canceled and the Buyer will be notified by email.
In accordance with current legislation on electronic signatures, the online transmission of the card number for order validation is considered proof of the order and makes the sums that the Buyer has undertaken to pay for said order payable.

Via Paypal
The Buyer can pay for purchases using the online payment service PAYPAL. All they need to do is create a PAYPAL account. With PAYPAL, you can also pay without creating an account using Visa or MasterCard.
Fight against fraud
Credit card payments can be verified via the 3D Secure protocol.

In addition to PayPal, the following online payment methods are accepted:

Payment dispute
Furthermore, BRUNELLI & CO SRL reserves the right to refuse any order from a customer who is not up to date with payments or with whom there is an unresolved dispute regarding the payment of a previous order for a legitimate reason relating to the anomalous nature of the order or an irregular payment method.
If a problem is detected, BRUNELLI & CO SRL will have the right to block the buyer's order until the problem is resolved.

Retention of title clause
For your convenience, Brunelli & Co SRL retains ownership of the delivered items until the order has been paid in full by the buyer.

Warranty
The development of our products requires rigorous selection of materials and meticulous attention to detail. All products are manufactured and distributed in compliance with current Italian legislation.
If, despite all precautions taken by BRUNELLI & CO SRL, an item is delivered damaged or incomplete, or if a defect is discovered, BRUNELLI & CO SRL undertakes to replace it or issue a refund. Simply call our Customer Service at 02 49539790 (local call rate without surcharge from a landline varies depending on your operator) and return the item.

Liability – Force Majeure
In accordance with the law, BRUNELLI & CO SRL cannot be held responsible for the failure or poor performance of the contract, whether entirely or partially attributable to the Buyer, or to an unforeseeable and insurmountable event of a third party to the contract, or to a case of force majeure.
In the event of an event constituting force majeure, BRUNELLI & CO SRL will notify the Buyer as soon as possible.
The Parties agree that they will work together as soon as possible to determine the methods of fulfilling the order for the duration of the force majeure event. Beyond the ONE (1) month period of interruption due to force majeure, BRUNELLI & CO SRL may not fulfill the order and will be responsible for refunding the Buyer.

Update and modification of the general conditions of sale
These conditions apply for the entire time the products presented for sale by BRUNELLI & CO SRL are placed online.
BRUNELLI & CO SRL makes every effort to ensure the accuracy and timeliness of the information published on the Site. However, given the volume of information processed and despite all its care and vigilance, BRUNELLI & CO SRL cannot guarantee the accuracy and/or completeness of all the information made available on the Site. Any input or technical errors that may occur during the time the information is published will be corrected as soon as they are identified.

Disability

Complaints or disputes will always be received with kindness , and the good faith of the person reporting a situation or complaint is always presumed. In the event of a dispute, the Buyer will contact BRUNELLI & CO SRL to obtain an amicable resolution.
In the event of difficulties in applying this contract, the Buyer has the option, before taking any legal action, to seek an amicable solution with a professional association, a consumer association, or any other lawyer of his choice.
Please remember that seeking an amicable solution does not interrupt the implementation of legal guarantees.
This amicable resolution clause is not mandatory. It is merely a possibility, as some disputes require urgent action, using any legal means.

Applicable law and competent jurisdiction
This Site is created by BRUNELLI & CO SRL, a company incorporated under Italian law and subject to Italian legislation on sales, information, and consumer protection.
The contract is governed by Italian law. The language of this contract is Italian.
Failing that, the competent court in the event of a dispute will be that of the defendant's domicile or, at the defendant's discretion, of the place of actual delivery of the product.
